A Study On The Democratization Of Judicature In Contemporary China

In recent years, our country continues to move forward on the road achieving judicial democratization. In the process of judicial practice, the concept of democracy has been paid more and more attention. But there are more and more debates about judicial democracy, and some scholars even have doubts on going the way of judicial democratization. So we need to deeply analysis theories and controversies, which related to judicial democratization. Admitting the jury system is the best method to balance the relationship between judicial democratization and judicial professionalization. We should have a firm belief in the path of judicial democratization. Firstly, we study the concept of democratization, which is the superordinate concept of judicial democratization. We further explain judicial democracy and judicial democratization. Then, we should explain a problem that judicial democratization possesses a strong theoretical foundation and it has various manifestations why the judicial democratization has been proposed. Secondly, we through detailedly analysis some issues which exist in the process of democratization, we should take a series of targeted ways to make some contributions to the judicial democratization and continue to improve the construction of China’s judicial democratization.
