In present society, criminal offenses tend to organized. Some criminal offenses are groups and criminals uses high-tech criminal measures and skills. It is hard to collect evidence,punish crimes and it will lead to increase the cost of justice. Faced with such a judicial situation, we need a litigation system that can obtain evidence and improve litigation efficiency. Tainted witness system is an effective method to solve this problem and many countries have applied it. If existing judicial resources cannot obtain key evidence and punish crimes need greater cost. In that case, the prosecution can exempt from criminal responsibility for people who own key evidence, punishing more serious crime of offenders. Currently, tainted witness system is not to exist in our country’s litigation, but it is necessary to try to establish China’s tainted witness system. We should take the immunity of tainted witness system in foreign countries and establish the tainted witness system in our country.
