A Study On The Current Occupational Guardianship System In China

Guardianship system is the progress of human civilization, embodies the national humanities concern for vulnerable groups. With the rapid development of economy, our country in various fields such as politics, economy and culture have changed dramatically. These great changes make guardianship system lag behind the development of today’s society, showing a series of problems. Especially when the onset of mental patient cases occurred frequently, an aging population growing, under this background, discusses how to make the guardianship system to better protect the vulnerable groups, is an urgent practical significance.Although academia had certain problems with adult guardianship system research results, the author summarized and carding predecessors in view, at the same time put forward its own views. Research and writing of this paper mainly use the historical analysis, comparative analysis method, case method, and the value analysis method..This article will revolve around the adult guardianship system, which is divided into four parts:The first part is an overview of the adult guardianship system. The first part mainly laid the foundation for guardianship system.The second part is the development of foreign adult guardianship system. Mainly illustrate them in the field of adult guardianship legislation idea, legislative situation and achievements in the reform practice, provides some enlightenment and summarized to provide reference to perfect the relevant regulations in China.The third part is the present situation of our country and the insufficient of our country’s present adult guardianship system. The author through the typical cases in today’s society to analyze adult guardianship system of our country’s and reveal some defects existing in the related system in our country at present. It will help to improve the system of adult guardianship working out pertinent measures.The fourth part is the construction of China’s adult guardianship system. China’s current adult guardianship system should be based on the absorption of modern concept of guardianship system and on the selection of the institutional framework system suitable for the situation of our country. The author found in the third part of the problem, put forward some modification and improvement suggestions.
