Research On New Type Of Crime

Crime of theft as a kind of crime against property category, its incidence is often directly proportional to the level of economic development; with the national reform and opening up and the continued rapid growth of China’s economy, the crime of theft is also showing a high incidence and in a frequent situation; as provisions relating to the theft in 1997’s Criminal Law has been unable to meet the requirements of the judiciary to fight against crime of theft.2011’s "Criminal Law Amendment(eight) " timely modified the terms of thief in a large scale adding burglary, theft with weapon, pickpocketing as an independent types of theft, but did not define a situation of large amount of money, which is significantly different from the earlier criminal law’s definition of the traditional theft, thus bring a new direction of research to the academia and the judiciary, in two years, after which appeared large differences in understanding the concepts of new types of theft and if there’s abortive theft in it.In the year of 2013 the Supreme People’s Court and the Supreme People ’s Procuratorate issued a " Interpretations on the use of laws in criminal cases of theft" for better judicial practice guidelines, giving a certain definition of burglary, theft with weapon and pickpocketing, but did not solve disputes of these three new types of theft in judicial practice and theoretical research, and therefore continued research is necessary, the new paper will discuss about the reasons for crime, understanding of the related concepts and the limits of abortive crime in the new types of theft, thus giving some suggestion in tackling with it.
