A Study On The Obligation Of The Lost Property

In our life, it is familiar that the holders of right miss a lot of things, owned or occupied. How to make the lost property successfully return to the right holder? It is very important that the law formulates systems of lost,inclding the right and obligation of the finder. In this paper, it firstly discusses four cases, then comparing national legislation with the one of our, we can found the shortage of the existing law at home. According to the shortage, we can have lessons from foreign legislation to put forward advice, to provide reference for our country’s legislation and practice.Finally, this article discusses the legal consequences about violation of obligations, including lost of rights, civil liabilities and criminal responsibilities.The value of law is implemented. The obligation of finder is produced in law to be practiced. The author hope that content of this paper could provide help for the current judicial practice, to solve problems in judicial practice.
