Research On Adult Guardianship System

Adult guardianship system is the corresponding system of Minors,which form guardianship system. In China, the existing adult guardianship system is mainly applied to mental patients, it will declare the patients with no or limited capacity directly without distinguish the actual ability, as a result, others who does not satisfy the condition will be excluded. Such Provision is contrary to the purpose of the system. After the 21 st century, our country enter the aging society, the challenges that china facing is more severe than developed countries. Countries around the world have surged the intention guardianship system under the guidance of the conception of self-determination right and normalization of life. However, our law is still blank in this part.Taking all factors into consideration, I start with implication of the adult guardianship system, Then focuses on the reference system that we can learn from other countries. Besides, I analyze the necessity and feasibility of the reform after introducing the current laws. at last, I put forward several suggestions of the system.
