| Law plays an irreplaceable role in human rights protection. Without law's confirmation, announcement and protection, human rights will stay in the state of moral rights or lack of relief when facing violation. Our country has a relatively complete legal system. Constitution and department laws work together, provide a network to human rights protection. In the complex structure, economic law is undoubtedly the most important part.This article attempts to re-interpret the becoming of economic law, and elaborates relationship between economic law and human rights from two aspects, basic theory and specific system. Traditional theory discusses it from the angle of elements. In my opinion, original legal departments can't provide enough protections to human rights. However, whether from macro-level or micro-level, economic law creates a new path to human rights protection, especially protections tilt to the vulnerable groups. Economic law contributes a lot to social stability. When a type of law has incomparable superiority in a field, it has legitimacy to be independent. Next, the article discusses the relationship between economic law and human rights protection from the core elements. Then we can prove traditional core elements essentially revolve around human rights protection. I single it out to emphasize it's important in the basic theory of economic law. Then, I want to give a clearer explanation to people and rights, people here are confined to the vulnerable groups, rights here are confined to rights closely related to people's basic survival and development. In the last part of this article, I would like to illustrate how economic law protects human rights from some typical systems. |
