Study Of The Safety Production Administrative Accountability Legislation

It's paramount to carry out the legislation over administrative accountability on work safety, aimed at standardized implementation of work safety laws, an improved administrative and managerial mechanism for work safety and a legal system on work safety. Moreover, such legislation is also a necessity to strengthen and clarify the governmental accountability on work safety, in order to promote a safety management and a government with responsibility, legality and democracy. During recent years, China has punished a substantial number of governmental officers due to their delinquency on critical work safety accidents. Nevertheless, many problems were exposed through the practices, and they especially came from legislative disadvantages of administrative accountability on work safety. Firstly, we fall short of the legal foundation for the administrative accountability on work safety. Secondly, we find a huge deviation among methods for the accountability. Thirdly, the standardization of the accountability is weak. Fourth, we lack the legal system in line with the accountability.Upon above problem, the article analyzes laws and regulations for work safety from a wide range of industries within China, and it explores the approaches to optimize the administrative accountability on work safety. In the first chapter, with the concept, definition and feature of the accountability, the article analyzes its theoretical foundation, as well as the importance and significance of the legislation. In the second chapter, with the introduction of the legislation status abroad of the administrative accountability on work safety, the article states the enlightenment revealed by the administrative accountability research and a brief analysis on the status and the existing problems of accountability legislation within China. In the third chapter, combined with the deficiency of the administrative accountability on work safety within China, the article proposes solutions and measures, which clarify the value and purpose of the legislation, establish a standardized law and advance the matched laws and regulations.
