Endless economic crime is one of the difficulties.In order to maintain social harmony and stability, our country has taken many measures to prevent crimes. Free sentence penalty system is a success. The article mainly discusses the topic that how to improve the penalty of qualification of economic crime in four factors.In the new century, economic crime has assumed new features, so now we need to improve the system of penalty of qualification. Firstly, I'd like to introduce the origin and the concept of the economic crime and discuss the implication of economic crime. Secondly I will compare the status of legislation of China and abroad. Then I discuss the topic from three points, which is the disadvantage of the system of penalty qualification, the need of the development of economic crime and strength the effect of penalty. Then, according to some foreign cases and our country's ancient relevant qualifications, relevant provisions of the legal regulations and the research of many expects,we have confidence that it is possible to improve the system of penalty of qualification.How to arrange and perfect the system of penalty of qualification is what we need to solve. In the article it can be divided into two parts:one is the construction of the system of penalty qualification itself; the other is how to use the system. Firstly, according to the objects, that are legal persons or natural persons, we can list them into different system. To natural persons, the penalty qualification includes:the deprivation of political rights; prohibit undertaking specific professions; banned as specific duties; engaged in deported. To legal persons, the penalty qualification includes:prohibit units engaged in particular business activities; Closures; Mandatory dissolution. Besides that, when we consider how to use the system, what we refer to is the applicable conditions and the commutation system. Although these ideas are still immature, in theory it has positive significance.
