Chinese Villager Autonomy Mechanism Study

Villagers' self-governance, a part of grassroots democracy, is the most extensive practice of our socialist democracy, and also the foundation of socialist democracy. Keep the villagers' self-governance in-depth and sustained manner in rural can not only benefit to social harmony, but also conducive to the reform of political system in China. The third Plenum of the 17th Communist Party of China Central Committee proposed that one of the elementary objects of rural reform and development is the better of the villagers' self-governance system and the effective protection of the democratic rights of farmers. Study the villagers' self-governance can rectify the fellowing viewpoints as "the democracy of villagers' self-governance is acts with undue haste too hasty", "villagers' self-governance is not accord with the practical situation in rural", " the problems brought from the villagers' self-governance has already indicated that it should be abolished", and so on. The study of villagers'self-governance is the urgently necessary to solve the problems concerning the agriculture, rural areas and farmers.The thesis introduces the history of villagers' self-governance, the constitutional significance and the characteristics of villagers' self-governance. Standing the legal view, conducts a systematic in-depth investigation and analysis about the difficulties and challenges of the origins, the development and the existing of villagers' self-governance. The author studies the theory with practice in order to discover the source of the problems facing by villagers' self-governance and put forward some sound theoretic and empirical thoughts.The present thesis puts forward that the following measures should be done to perfect the operational mechanism of the villagers' self-governance. Firstly, villagers' self-governance should stick to basic principles and implement the "four-democracy" strictly. Democratic election should be standardized to guarantee the villagers' right to vote. Democratic decision-making mechanism should be standardized to guarantee the villagers' right to make decision. Democratic management mechanism should be improved to ensure the villagers' right of participation. Democratic management mechanism should be improved supervision mechanism to ensure the villagers' right of superintendence. Secondly, it's proposed to straighten out the relationship between "countryside politics and village governance" and "the two organizations committee". It's proposed to change the local government's management style, strengthen the organization of villagers' committee and define the scope of the functions and powers of the Party organizations as distinct from the organizations of villagers' self-governance. Thirdly, it's supposed to strengthen the democratic and legal education and training in order to enhance the awareness of democracy and law, and to improve the ability of political participation. Finally, it's supposed to speed up the institutionalize process of villagers' self-governance. It needs strengthen the Constitution and the current legislation concerning villagers' self-governance. It's proposed that local government should make the best of local legislative competence to improve local matching regulations.
