Crime News Violations Of The Moral Rights Of Minors

Compared to other news, crime news is much more likely to infringe the individual rights, for the objects reported are special. What's more, the minor are more psychologically vulnerable than the adults. Once they are hurt, it'll be difficult for them to recover. In practice, it's extremely common to see that crime news damages the personality rights of the minor. Although the law is quite clear, the issue isn't taken sufficient attention and concern. I hope my analysis and suggestions of the phenomenon can lead the academic attention to the issue, which is more effective to protect the minor's rights.The first chapter is to clarify the relevant conceptions and theories. Firstly, I talk about what is crime news, minor and the personality rights. Secondly, I combed the course of the development of the theory of the press freedom, and try to tell weather there are conflicts between the press freedom and the personality rights. Meanwhile, I summarize special protection of children from the perspective of the human rights.The second chapter is to analyze and sumarrize of the current situation of the study of the infringment on the minor's rights by the crime news.The part is mainly based on newspaper samples.Through clarifying the roles of the minor in the cime news,such as suspecst(defedants),vcitims,relatives or else,and studying the cases,I give some coclusions.I also study the anti-trafficking events on the microblogging,and put forward some views.In chapter three, I analyze the reason for the infringement on the personality rights of the minor. I think it's due to the following reasons: firstly, the society lacks the culture of the personality of the minor; secondly, the academic studies lack the theoretical support; thirdly, the confusion of law and it's hard to bring a lawsuit, for the conflict of the central and local legislation; fourthly, the authorities'behavior make negative impact to the society; fifthly, the journalists lack the necessary qualities such as the lack of human care under the induce of the interests the lack of legal literacy leads to the damage of others'rights and wrong self-positioning. Lastly, victims sometimes don't sue for they may be not aware that their rights had been damaged, or they just want to keep the event silent, or it costs too much to bring a lawsuit.In chaptet four,I put forward some views on the way to protect the personality rights of the minor in the crime news.On the one hand,building the culture of the caring and respecting the chiledren.On the other hand,obeying the law,and lowering the difficulty of lawsuit.What's more,the media industry should make some self-regulatory mechanism which must be known and followed by the journalists and enstablish a self-regulatory body.CoculisonThe infringment of minor's personality rights by crime news is sever,we should concern about the problem. Only if we form the culture of the respecting and willing to protect the children,follow the dual regulations of legal and self-discipline,the issue won't be solved.
