Carrying-order-out actions by civil servant are universal in practice, and given special status by most countries as justification behavior. However, the research of justification behaviors has not still produced the great effect in our country's current criminal law, especially for"carrying-order-out actions by civil servant", one part of the justification behaviors, and there is only few people to study it. Pointing at the particularity of the carrying-order-out actions by civil servant, and combining with"the People's Republic of China civil servant law", passed on April 27th 2005.The paper sufficiently discussed some issues of carrying-order-out actions by civil servant in order to improve our country's criminal law practically and theoretically.The paper is divided into five parts: the notion of carrying-order-out actions by civil servant and related legislation cases of different countries and districts and comparison between them, the elements justified of carrying-order-out actions by civil servant, the general processing mode of executing illegal order actions by civil servant, the outlook of carrying-order-out actions by civil servant in our criminal law, and the last part is the improving of the related support mechanisms.
