Contract In The Legal Relationship In The Current Contract Energy Management System

Energy Performance Contracting ("EPC") is a kind of service system which can promote the power using units to realize energy saving with the marketing method. In the implementation and performance of EPC, a series of legal issues have been involved. Following the continuous development of EPC, the related legal affairs increased gradually. But unfortunately, the correlative discussion and research are almost blank in China. Herein, this article attempts to conduct elementary study on the legal nexus involved in EPC.There are three parts in the article as Introduction, Body and Conclusion. There are four chapters in the Body.Chapter 1 is the summary of EPC, mainly introducing the conception, development background and the participation parties of EPC project, meanwhile analyzing the types of EPC one by one.Chapter 2 is about the issues related to the Energy Performance Contract. Based on the conception and features of the Energy Performance Contract, the legal nature and legal relation structure are analyzed emphatically.Chapter 3 tidies all the policies and regulations on EPC since 2000, and points out several problems in EPC legislation in China.Chapter 4 puts forward relevant legislation proposals based on the characteristics of EPC.
