China is one of the most badly injured countries during World War II. The Chinese people suffered tremendous victimization in order to resist the invasion of imperialistic Japan. Militaristic Japan committed monstrous crime in china during the wartime. Warfare posed badly hurt and loss. After Japan surrender, Nan king national government set up the disposal war criminal committee in charge of work that dispose the war criminal. Among the count-martial that National government set up, the court-martial directly under the department of defense is especially important. Nan king trail not only posed the significant part of the counter Japan disposal . but also have important significance on the national memory. Therefore it is absolutely necessarily to study Nan king trail.My thesis divided into four parts. The first part reviewed the background of Nanking trail, including the disposal war criminal policy of the league, the policy and institution of national government, the setup of the court-martial directly under the department of defense. The second part is about the setup and constitution of the court-martial directly under the department of defense, the mainly content is about legal principle foundation, court charter, and composition, setup and trial program. The third part mainly taken the case of Nan king massacre as representative inspects the process and procedure of the court. The last part mainly inspected from the social angle, including the society participation, the society disseminates the differences between the populace emotions and the policy of government. Through such more than one kind of angles inspection, I attempt to outline the overall profile of the trail of war criminal, In this foundation, I will conclude some objectively understanding on this subject. Thus, we can reconsider restricted factor, social influence and historical significance of Nanking trial.
