| This paper is mainly to study S.E.Toulmin's model of argument. On the basis of an analogy between logic and jurisprudence, Toulmin brings up a procedural model, which is composed of six functional elements: claim, data (ground), warrant, backing, qualifier and rebuttal. The paper can be divided into five parts. The first part introduces the background of Toulmin's model of argument. The second part introduces the six elements and the basic forms of Toulmin's model of argument. The third part compares Toulmin's model of argument with traditional model of argument, then it indicates the breakthroughs of Toulmin's model of argument. The fourth part introduces the responses to Toulmin's model of argument in the academic circle. The fifth part illustrates the theoretical and practical meanings of Touimin's model of argument, and it also explores some opinions about warrant, which is an important element. Finally, on the basis of exposing the deficiency of Toulmin's model of argument, it extends the model. |
