As the globalization of world economy keeps developing, trade relations among countries concerning not only trade in goods but also increasingly involved in trade-related investment, intellectual property issues, as well as environmental protection, labor standards. Since the establishment of the WTO, social problems like labor standards have gradually been concerned by countries, especially the developed, all over the world, who continue to raise labor standards in terms of integration into the multilateral trading system, which get opposition from developing nations. Although the developed and developing countries have been split on the issue, there are certain links between the labor standards and trade that makes them influence each other. This Article focus on the different attitudes between developed and developing countries on the issue of labor standards in international trade , based on affirming the labor standards and international trade association, expand discussion in the development of labor standards, its implementation approach and the conflict of the rights involved the implementation, then made recommendations on China's policy response.This article is divided into five chapters. The first chapter introduces the content of the labor standards and the core labor standards. Chapter II lists the main views on the issue of labor standards in international trade, summarizes three legal issues (conflicts of the inter-State conflict of law value, national interests and the legal system demands),and makes a number of principles such as the priority of labor interests, etc. Chapter III describes the way to resolve the dispute with relative principles and reveals the shortcomings of the protection of labor interests through trade sanctions. Chapter IV analyzes the main controversial issues and practice in the global scope, regional scope, countries ,and international rules of industry field. Chapter V suggests the Chinese position and countermeasures in dealing with international trade and labor standards issues, based on China's specific national conditions...
