| Creative industries is based on personal creative intellectual achievements of the creator, the core value of which is creativity and innovation. Copyright is monopoly rights privileged to the creator's achievements with relevant laws.However, the disadvantage of copyright protection is in contrast to flourish of creative industries. In 2005, the country's copyright administration institution handled a total of 10,787 copies of the registration contract and creator voluntarily registered 58,523 pieces. The phenomena is incompatible development of the creative industries because between them there is a huge omission: although whether registration the author determine, it does not affect the registration of authors to enjoy corresponding rights and interests, the voluntary copyright registration can help copyright holders to identify and make sure who owns the rights, thereby reducing related rights disputes. In addition, the regisration can be the provement of holding the rights and the evidence on the court if the torted copyright holders need to allege their rights.There are wide range of factors caused disadvantage copyright protection: not only for the reason on the weak protection of the holders' own sense , but also for the faulty national regulations. In all, there is a thing can make sure that if lack of copyright protection, large investments (such as research, design, production and other activities needs to spend manpower and material resources) made by original writers in the creative process is difficult to recover or even be wasted. If lasting long enough, it will seriously hamper the develpoment in creative industries and products. So it's very important to manage copyright for development in the creative economy. Nowadays, copyright has become a very core and important factor in creative economic activities.Through the research on general instance of copyright protection and special circumstance in Hangzhou and from two sides of basing on Hangzhou, making creative industries in Hangzhou standard and to follow the life cycle of products in creative industries, this research paper will discuss on how to better protect copyrights, thus to promote creative industries to be better developed. This paper is divided into five chapters.Chapter 1 is the Introduction, the paper introduces two definitions of Copyright and Creative Industries, and illustrates briefly the research situation on these two domains and the results from the cross-research of the two domains.Chapter 2 is the manifestation of creative economy. This chapter is divided into two section which discuss the economic benefits from the creative industries and the development of creative industries in Hangzhou. On discussing development of creative industries in Hangzhou, the paper analyzes the advantages for creative industries development in Hangzhou from four aspects: culture, human resources, the demand of creative industry and the importance government attaches to. At the same time, in this chapter, the paper illustrates the development, the changing situation, and the benefits from them of several creative industries in recent years: animated cartoon game industry, and software industry, culture and leisure industry, the press and publishing industry as well as art market, art performance market, information services, design services, radio, television, and movies.Chapter 3 is the chapter expatiating "The importance of protecting copyright to the creative industries". The chapter outlines the copyright protection measures and the situation in Hangzhou, synchronously accomplishes with praise. From the characteristics of creative industries which is easy to be copied and also belongs to be one-consumptionrism, therefore, the hazards of piracy on the creative industries in the enterprise or creators are not to be underestimated. It would have greatly undermined the creator's enthusiasm. Hence, countries all over the world promoting the development of creative industries have attached importance to the protection of intellectual property rights. As the methods relating with the protection of intellectual property, the copyright protection is the core.In Hangzhou, the municipal government actively develops the copyright protection in recent years. Through copyright protection campaign, and based on vigorously striking against piracy, promoting genuine software in municipal government, continuously expanding the service areas of copyright, and establishing computer software copyright registration and trade associations or so on, the municipal government effectively protect the copyright to the development of creative industry in a favorable environment.Chapter 4 is the suggestion on copyright protection work. Based on principles of the creative industries in Hangzhou, the paper advises that Hangzhou municipal government should follow two aspects: First, to establish the classification of creative industries. In that case, it's easier to manage the copyright and to make the policy according to sector-specific characteristics. Second, to carry out copyright protection activities according to the characteristics of every phase in the creative products' production process. |
