| With the wide application of the technical production in the world, high-technology becomes the object of the trade and the dominating supporting force.《Agreement on Trade Related Aspects of Intellectual Property Rights》(TRIPs) made on Multilateral trade negotiation Uruguay Round indicates that world Intellectual Property comes into a global protection stage with high standard and high level, Intellectual Property has penetrated into international trade from traditional cultural field. As a general attendee, we China has signed the package agreements including TRIPs, our Intellectual Property protection system will tend to consistency with the world. This study attempts to fill some of gapes in how Chinese international technology trade will get along under the TRIPs, and to draw implication for policy constitutor.This paper mainly employs an economic point of view to analysis the intellectual property rights rules and regulations under the WTO-TRIPS agreement which as a global system and its impact on Chinese high-tech trade and the intellectual property rights protection. The development trends of the future trade pattern clearly indicated that with economic development and high technology products development, the future trade will be more relying on the IPR related value added goods, If not properly dealed with, it will be a source of friction for international high-tech trade.This paper starts with the introduction of the relations for high-tech IPR to economic development, then discuss about the major points of the trips agreement and the basic principles for IPR in high-tech. It also conducts a multi-viewpoint analysis of request on the protection of Chinese international high-tech according to the new trend of the international stands, and then analysis and compare the cost and benefit on the typical industries which resulted by strengthen the protection of intellectual property rights; in what follows, indicating the gap and difference regarding the international regulation, meanwhile providing the basis for negotiating position with developed countries. Besides, with support of that analysis, the papers conclude and propose some management strategies and technology trade measures for the protection of high-tech IPR and trade. |
