Study On Rectification Of Illicit Constructions

Along with the rapid urbanization since the very beginning of reform and opening-up 30 years ago, various contradictions have been coming out in the city public administration, among which illicit construction impeding further development of our cities, a tough problem hard to rectify completely in urban administration, has become one of the concerns of public administration. Therefore, importance must be attached to the intensive rectification over illicit constructions. It is an important means of how to create an agreeable living environment in the interest of our people for social development, how to handle the hit concerns of our citizens, how to host a successful Shanghai World Industry Expo 2010 and, most important of all, how to build a more harmonious society.So far as my research methods are concerned, this paper will stand firm on the ground of literature research ,analysis through comparison upon the writer's work experience, and from the two dimensions of theory and practice, it is also meant to analyse some real cases in the process of rectifying illicit constructions with the inclination of combing carefully the state law and Shanghai regulations concerning how to deal with the illicit constructions and to get it defined what constructions are illicit, simultaneously pointing out the current existing problems; no precise definition of illicit constructions can be found in the related laws, nor can the regulated stipulations because these administrative regulations can only be found in the specific stipulations of various trades. As a result, the job of rectification is rendered somewhat ineffective. Next, this dissertation will sample Shanghai Minhang District to analyse the different kinds of the issue, causes, and bad results. Based on the useful experiences in illicit constructions by Shanghai Minhang District, Hefei city of Anhui province and city of Nanjing of Jiangsu province, this thesis will also focus on some new ideas and patterns on how to rectify illicit constructions; that is to say, to further expand the domain of administrative system through integration of check and drain, legislation security, classified rectification and reasonable penalty, to form a new pattern for rectify illicit construction through the combination of administrative resources, adjustment of administrative methods, and to perfect administrative mode for rectification through participation of the whole society to bring into full play the functions of multi-responsibilities for the various social bodies.
