With the steady improvement of our financial market innovation, stock index future will be debuted at an appropriate opportunity. In recent years, Chinese forward market is expanding by leaps and bounds. With rapid economic development, legislation becomes faster. By now, preliminary law and regulation system has already been built up. But facing the fact that Stock index future will be debuted soon, we do not have perfect laws and statutes system to evade high risk,congenial ,high legal action. It is not easy for us to avoid grave malpractices and the chaos business order .What is more, it is hard for us to realize"open and impartial"business principles. New law and regulations have some pities.Forward market has no way to adjust itself. How to protect the benefit of investors and futures company, how to strike information cheating in the cross- market, are the legal problems we need to solve as soon as possible. It is necessary to analyze these problems in law sight.This thesis begins with the definition of stock index future legal relation particularity. Using demonstration analysis and comparatively analytical method, the author studies the stock index future and the stock market's regulatory system on the basis drawing abroad experience. Secondly, the thesis reveals how to perfect our country"increasing futures caution money system". Thirdly, the author comment on futures investor credit system.The main body of the thesis is composed of four parts:Part I, Stock index future legal relation particularity is presented. By analyzing stock index future legal relation particularity and their problems, The author analyze concretely stock index future legal relation particularity, in the main body, the object, the main body's right realizing aspect. At last, the author investigates there are three legal problems before stock index futures. Studies of regulatory system across marketplace are presented in Part II. This paper analyzes cross-market information conduction character- istic and effect. Then, cross-market overseeing experience being studied, the author bring forward drawing lessons to our country significance. At last, through comment on low breaking law cost, the author brings forward the guiding ideology and concrete methods of cross-market informationsupervision. In Part III, how to perfect the system of increasing futures caution money is presented. At the beginning, the author discusses the current laws being stipulated. And then, the author study high risk situation of the Futures Company. Enforcement is also being studied. Finally, two concrete proposals are given.Studies of futures investor credit system are presented in Part IV. On the analytical basis in credit system current situation, the author suggests we should build up the credit the futures investor system. Through perfecting our country investor's credit law and regulation, overall strength of futures of our country industry can be advanced.Resolving these three legal problems can help Futures Company guard against risk. These suggestions can make futures market bring bigger effect into play in national economy. This thesis hopes to provide the forceful law guarantee to the financial market. Therefore, this idea can enhance financial strength. We are looking forward to a glorious future of our country futures industry, under the control of law.
