The Investigation And Study About The Students' Privacy Of Chinese Colleges And Universities

In recent years, more and more university students lodged cases to court against universities in order to protect their right of privacy. On the one hand, students'Legal Consciousness constantly enhance, but they can not clearly understand the scope of their rights; On the other hand, affected by traditional concepts of education, universities' administration authority and the right to know is expansion, but they did not attach enough importance to the law. The basic reasons of these phenomena as follow:laws and regulations to protect college students'privacy are inadequate, and most of them are lack of maneuverability. It is mainly expressed as follows:in the first place, the indirect way of protecting right of privacy will go against to sustain one's human rights; second, legislative bodied pay less attention to protect students'privacy, they did not work out specialized law items to regulate college students'privacy until recently. The laws which have already been formulated were lack of systematic and coherence; Third, there is no specific regulations to protect student privacy in colleges. Therefore, it is quite necessary for us to research students' privacy protection. Then, we can take effect measures to maintain students'personal dignity and individual privacy and promote the process of managing universities by law.This thesis is based on the investigation of the necessity and feasibility about protecting students'privacy. It has solved these problems:firstly, I research and analyzed existing theories and cases, then identify the notion, connotation, characteristic, contact and scope of the students'privacy; secondly, I analyze the concrete manifests of infringing students'privacy and clarify the reasons; thirdly, based on present situation of research on some countries'legislation, I point out the legislation direction of Chinese students'privacy protection. Fourthly, I show the way how to protect students'privacy.
