On Joint Negligence Crime

The problem of joint negligence crime has been disputed for many years,but it's difficult to reach a consensus both at home and abroad. Admitting joint negligence crime means regarding it as a whole and adopting the principle of joint liability, while denying it means regarding it as a individuality and adopting the principle of individual liability. Chinese current criminal law has definitely denied the joint negligence crime, but there are many cases that two or more people cause harm results in judicial practice. On the basis of the judicial practice and the experience of the antecedents, the author of the article discuss the problems referred to the disputation of joint negligence crime, the contradictory between the legislation of Chinese criminal law and judicial practice, the necessity of establishing the principle of joint negligence crime, the establishment conditions,the establishment scope and the punishment principle of joint negligence crime, which hopes to contribute to the improvement of the legislation of joint crime in our criminal law.
