| Along with the rapid economic development and improving living standards, more and more people become car owners. China's vehicle fleet growing is accompanied with frequent traffic accidents. In the context of People's rights protection awareness growing, more and more people chose to defend their rights and interests through law, which also led to a large number of traffic accident damages cases in grass-roots courts. However, China's current system of compensation for accident damage is not perfect, there are a lot of problems.This is very unfavorable both for the victims and the court judge. Based on this, we must identify these issues and propose appropriate countermeasures.This article is focusing on the prominent problems that existed in our current system.They are the principle of attribution of traffic accident compensation, the compulsory insurance,the death compensation, the compensation for spiritual damage,social welfare fund for traffic accidents and so on. The discussion is in order to explore the methods to perfect China's system of road traffic accident damages, which also with a view to provide a useful reference for legislation and practice in China. |
