However, look at our legal system in the current, there are no laws regulate the soil pollution in rural areas specifically. This case emphasises the difficulty of soil pollution in rural areas of our country. Therefore, the legislative study on soil pollution in rural areas become an important issue that we must to fact.For the serious situation of rural soil pollution currently, combined with the research status and development trends in rural soil pollution prevention of domestic and foreign. This paper sets off the rural soil contamination and control overview at first, through definites related concepts, analyzes the present situation of China’s rural soil pollution and the pollution’s reasons and harm, then lets the public understand the necessity to prevent soil pollution in rural areas. Secondly, straights into the subject, from a legal point of view, by studying the relevant provisions of rural soil pollution prevention in the Constitution, the Basic Law of Environmental Protection, the Environmental Protection single laws, the administrative regulations and rules as well as some of the relevant norms and standards, in order to analysis the legislative status quo and problems of China’s rural soil pollution prevention. Third, through analyses the rural soil pollution prevention legislation of the typical countries in foreign, such as US, Germany, Japan an so on, then combined with China’s reality, to arive the inspiration of the prevention of soil pollution legislation to China. Finally, by studying the aforementioned problems of soil pollution prevention legislative in rural areas, combined with the revelation from the typical countries, then put forward the idea of soil pollution prevention legislation in rural of China. At last, by analyzing the problem and inspiration, proposed the legislation idea of China’s rural soil pollution.
