Study On Environment Protection Law In Coal Resource-based Regions

In China, the distribution of coal resources formed some coal resource-basedregions. These areas develops mostly because of their coal resources, obtaining hugedevelopment and becoming economy pioneers in the surrounding areas, but alsosuffering severe negative environmental impact. This article selects Jin-Cheng, thecomparatively representative of Shan-xi coal resource-based region, as the mainresearch object, aiming at comprehensive research on China’s new law environment andthe coal resources areas environmental protection law, and analyzing these laws to itsrelevant regulations, setting up the theoretical basis, implementation status, exploringwhether there is a problems in-depth, putting forward some suggestions for environmentprotection and sustainable development of coal resource-based regions.Through the study, it was found that at the basis of sustainable development,environmental cost, and ecological compensation and so on, China has established adistinct system for the coal industry and environmental protection. This system providesthe guidance of the principle of environmental protection for the coal resource-basedregional problems with Coal Resource Law, environmental protection law as the core.But through the example analysis of Jin-Cheng area, it also exposed some problems inthe legal system. These deficiencies are from both local relevant supporting facilities,such as education, environmental protection consciousness, etc. and also due to that thehost law is so principle that lack of specific operations, and local regulations lag at thesame time, failing to fill the gap caused by accordingly.By using the experience of the United States and the European Union, the authordesigned four systems in building China’s coal resource-based regional environmentprotection law, which are respectively the planning legal system of environmentalprotection in coal resource-based regions, the main body of legal system, coalresource-based regional pollution emergency response system and the legal system forprotecting coal resource. These four system will be able to help the coal resource-basedregional environment protection ways’ innovation, set up the scientific environmental values, perfect the legal systems of coal resource, establish strict appraisal system,realize the deep development of the coal resource-based regions, really establishlong-term effective mechanism of coal resources protected by the laws, giving full playto the role of the legal system of coal resources.
