Study On China’s Ex-ante Regulation In The Field Of Environmental Laws

In the past thirty years of Reforming and Opening up Policy of China, social and economic development has been known as a miricle. To be objective to this thirty years of gain and loss, we should pay higher attention to the price we paid in exchange of the great economic growth. In the past thirty years, China’s social and economic development has caused enormous destruction to the environment. At present, we have already seen the likely barriers in front of our future development economic development. In addition, the pollution of the environment has already greatly affected the residents living environment, haze, acid rain and other weather disasters have practically affected China’s residents’ life. To change the mode of economic development, and the construction of eco-friendly model of economic development has become an important task of economic development. To solve China’s current environmental pollution problems we have now, we need to understand objectively China’s current environmental situation. On the one hand, current pollution should be to restore by changing the mode of economic growth in order to control the main pollution, eliminate significant damage to the environment of industry and enterprise, make the natural environment to recuperate and build up strength. On the other hand, the planning and construction of future economic development should be modeled the economic impact of the environment into the economic development strategy, economic development planning and the economic development of specific measures. The pursuit of the harmonious development of economy and environment should never stop, preventing potation before it happened is what we should do.In the process of environmental pollution control, pollution of the environment supervision will be an important aspect in solving environmental problems in China. To pollution that has already happened, supervision of pollution control plays the role of either means and standard of evaluation, that is to say, the supervision of the environment pollution is not only to control pollution but also to judge the results of pollution; for the future economic development, environmental pollution supervision plays the role of balancing the harmony between environment and the economy, evaluate and foresee the possible impact the economy may put upon the environment. And put compulsory measures to guarantee the supervision of the corresponding environmental pollution. The supervision of the impact of future economy on the environment is the main topic of this thesis. From the perspective of administrative law, it is very necessary for the legal thinking and analysis to environmental pollution supervision in advance.The supervision on pollution in advance is an important part of the whole pollution supervision system. This thesis put numerous efforts on the analysis of the superiority of supervision in advance, examining the value of the environmental pollution supervision in advance in environmental pollution monitoring, and combining the current situation of our country, try to find out some problems existing in our country’s current environmental pollution supervision in advance, then analyse the cause of the problem, try to design future pollution supervision in advance in Chine, so that China’s pollution supervision in advance can more fully play a positive value in the pollution control.
