| With the development of the market economy in our country, the demond of credit guarantee for the Small and Medium-sized Enterprise(SME) increase rapidly.The number of financial guarantee company is becoming larger and larger.The financial guarantee company enters a fast development period. Behind the prosperity of the financial guarantee company,there are huge risks.In 2008,the most famous guarantee company of the guarantee trade burst out crisis and was close to bankruptcy.Until that,the problems of the guarantee trade in our country such as'the disordered development',the'operation in breach of regulations','the inefficient supervision'have been exposed.So to realize the effective supervision for the financial guarantee company, how to regulate the financial guarantee company,how to build a perfect legal system received wide attention from scholars.In China,the administrative supervision is the single form of regulation of the financial guarantee company. The content of supervision only focus on the aspect of SME credit guarantee.Mostly based on supervision is a number of regulations of government departments.Because the scope of the existing supervision system is too narrow,it can not adopt to the development of China's financial guarantee companys.So what are the new features of the financial guarantee company? What are the new challenges of the existing supervision system? How to build a new supervision system to respond to these challenges?In analyzing the supervision, the author uses deductive method, the induction method, the comparing analysis method and the method of citing typical cases to analyzes the supervision of the financial guarantee companys and get the general ideas of how to build a new supervision system.There are four parts in this thesis which separately analyzes the new features of China's financial guarantee company under the market economy,the major risks whice the financial guarantee company faces,the status quo and problems of the supervision of China's financial guarantee company,the comparative analysis of the international supervision system of the financial guarantee company, the way to improve the supervision system of China's financial guarantee companys. |
