Research Of Responsibility Cognizance Theory And Implementation Of Its Application System

With the development of economic, science and technology, the E-commerce industry growing rapidly, more and more people and enterprise choose to do commerce activities, sign electronic contracts, pay on-line with the approach of E-commerce. However, more disputes appeared accompanied by the increase of trading activities. For example, a participant of a contract denied his/her content of the contract after he/she had signed for it, and then made a dispute between the participants of the contract, while there lack of a mechanism which could be used to resolved the disputes in the Internet world just like in the real world. In the project 'Research on Modern Service Industry Common Service Integrate Technology' which belongs to the 11th Five-year's National Key Technology R&D Program, a service which named 'responsibility cognizance' has been raised to address this problem.However, the responsibility cognizance in the project is still in its initial stage, the theory of it has not mature yet. So this dissertation researched the theoretical system of responsibility cognizance based on the definition of the responsibility cognizance in the project firstly, and proposed a kind of new theoretical system which named TORC(Theory Of Responsibility Cognizance), this theory used a "layer model" to describe the constitute elements of the system of responsibility cognizance, and constructed the working mechanism of the responsibility cognizance in theoretical system from the aspects of classification, working flow, related services and how to begin the service. Which means that this dissertation constructed a theory from the angle of 'static'-the constitute elements and the angle of 'dynamic'-the working mechanism. Then this dissertation had a discussion on the important material foundation - electronic evidence and theoretical foundation -non-repudiation protocol in the system of responsibility cognizance. The relationship of evidence, electronic signature and electronic evidence has been sorted out in this article, which made a foundation of using electronic signature as a legal effectiveness evidence in the responsibility cognizance. For the reason that there are some requirements in law for using electronic evidence as a effectiveness evidence, a kind of process criterion of electronic evidence and a kind of form of electronic evidence has been proposed; For the non-repudiation protocol, this dissertation pointed out the types of existed protocols and the limitation when they are used in the applications of responsibility cognizance, and then designed a new protocol which is suitable for being used in the responsibility cognizance, with a analysis on its fairness, security and practicability. At last this paper designed and implemented a responsibility cognizance system, this system could provide a kind evidence service which make up of evidence creation service, evidence storage service, time stamp service, evidence acquisition and verification service and evidence querying service. It also could be integrated by the E-commerce application simply, which meet the integration requirements of the project of 'Research on Modern Service Industry Common Service Integrate Technology'.Compared with the traditional services, theories and applications which are similar with the responsibility cognizance, this dissertation's work on the theoretical system of responsibility cognizance, electronic evidence, non-repudiation protocol are based on the practical requirement and features of E-commerce market and applications. This makes a reference to the implementation of responsibility cognizance in the future; the application system which is implemented has been partly used in a E-commerce website which named "foodqs.com" and a virtual trade website which named "mibao8.com".
