The ground issue is the key issue of the economic development and construction of China. Chinese reform and opening up started from the reformation of rural ground institution. The rapid economic development and the advancement of industrialization within the recent 30 years depend mostly on the transformation of the rural ground from rural use to city construction use. At the same time, there are some problems and contradictions going along with the reform process. Many economic experts have made deep and systematic research. The government and the peasantry themselves also have made positive progress and attempt. Based on their practice, this paper tries to analyze the reasons of the transferring problems of the rural ground from the visual angle of influencing mechanism of property rights institution upon the economic operating of the modern property rights theory.The influencing mechanism of property rights goes as follows: under certain economic and legal circumstances, property rights affect the behavior, expectation and targets of the individuals with property rights through certain property structure. The property rights contribute to the production growing, productivity increasing and cost reduction through the function of encouragement and resource optimizes of property rights. At the same time, if the price and technology factor of the economic environment or the preference changed, the property rights would also be changed by the individuals with the rights and economic performance.This paper recognize the positive role played by the ground property rights institution in the original period of Chinese reform and opening up. It helped to encourage the producing interests of Chinese peasants, increase the agricultural production and productivity and increase the peasantry income. But with the rapid advancement of industrialization, the operating environment of the property rights have changed greatly which made the Chinese rural ground property rights institution lag behind the economic development. Problems are that the land using efficiency is low, the cities made excessive expansion and some social contradictions caused by the invalid protection of the peasants who lost their lands. This paper puts forward the reason should be the lagging behind of the perfection of the rural land institution compared to the speed of the industrialization. The dualistic land property institution between city and country affected the economic development. The legal system about the land transferring is not perfect, which influenced the protection of the peasants who lost their land. As a result, the positive efficiency of the property institution does not show up and the perfection process is necessary.According to the analysis of the reasons, this paper puts forward some policy considerations such as the unification of the land dealing system which will help change the dualistic actuality of the land property system, perfection of the legal system, perfection of the social ensurence of peasants who lost their land and the deepening of the land transferring process. We are happy to see that deepening of the land transferring has been paid great attention by the government. And that will inject new energy into the Chinese harmonious construction of economy and society.
