The traditional economy has resulted in many global problems,For example,environmental destruction,resource depletion,etc.So,the circulating economy has been seemed as the best choice to deal with these problems and it also has become the international wave since the 90's of last century.It is the best economy pattern of the future days.It contains the latest concept about environmental protection and new relationship between human and nature,secures the principle of basing on humanity and also the way to sustainable development.The law of circulating economy is the safeguard of the practice of the circulating economy.This paper reaches some conclusions from the current situation of the law of circulating economy in China:it is in the very beginning stage and has some problems.Firstly,the legislating ideas didn't reflect the content of circulating utilization and sustainable development.Secondly,the legislating structure lack the synthetic laws and some are blank at all. Thirdly,the legislating effect is not very practicable or coordinate and it is not reasonable in the supervising and evaluating system.So,this paper discusses the necessity of the construction of the law of circulating economy,expounds the mature experiences of developed countries.This paper also gives some practicable advices to the construction of this kind of law in China:the principles and ideas about legislation.We should consummate our construction of circulating economy from both the economic pattern and the content of the law.The aim is to bring this law's protecting and guiding function to Chinese circulating economy into full play,promotes the construction of the harmonious society and the sustainable development.
