Since the Mid20th after the World War Two,the new international trade system has been established under the avocation of the GATT and its subsequent WTO which accelerate the Process of the globalization of economy. With the development of integration of economy and technology, the protection of intellectual property rights (IPR) are striding towards internationalization and becomes increasingly important. Technological property rights-related trade of IPR in undergoing a fast development becomes faster. Developed countries bring IPR agreement into the international trade and finally promoted the form of TRIPs Agreement. As a member of WTO, China should comply with the rules of WTO and its related agreement when embarking upon foreign trade and international competition. On one hand, we must acknowledge the positive impacts of TRIPs on Chinese technological property rights trade, on the other hand, we realize that Chinese law on IPR protection still has some disadvantages compared with international treaty. We should make a great effort to carry out the strategy of IPR protection to make our enterprises have more attention on IPR protection and make a good use of IPR to maintain our advantage of competition.This article firstly introduces the topic, the significance and literature summary. The second part includes the claims and rules of technological property rights based on TRIPs. The third chapter discusses the terms of technology trade. The fourth and the fifth chapters are the main part of this article, which the fourth part investigates the influence of the exchange of technological property rights on the growing of our economy by using econometric model, and the fifth part gives the advises of technological property right trade. At last, in the sixth chapter, this paper shows some conclusions.
