This paper utilize the historic analyses method and the foreign comparative method, has studied the development process of China's banking industry associations and law, analyzed the current situation of China's banking industry associations, and learned some experience from abroad Banking Association, to explore the association of China's banking industry current development issue.The paper view that in current situation, which a free market and private banking competition existed, the banking market failure and government monitoring failure is the reason of Banking Association come in to being Comprised of by many commercial banks, its main aim is to safeguard the interests of the industry organizations, to be the Intermediary organization between the banks and between the banks and the financial market intermediary organizations, is a bridge between the government and banking links. Main functions of the Banking Association are self-discipline, the availability of market information, communication and co-ordination, planning for the development of the industry, jointly organized education and training. The article realizes that some problems currently existed in the banking Association. Such as lacking of legal safeguards, uncertain its position in the fields and lacking of authority and other issues. Pointing out to the specific situation in China's banking industry associations, we should find a perfect development path fits for their own characteristic, which is to be legally defined, namely, China's banking industry is a self-regulation, non-profit community organizations, and is the link between the banks, as a bridge between the government and banks; Clear Banking Association functions and powers; Banking Association perfect management system, Banking Association and the establishment of partnerships between the CBRC; strengthen themselves, establish uniform system, mechanisms and employment mechanism leading scientific, reasonable collection of contributions, independent of functions, establish an open, fair, and to the pursuit of social responsibility image. Only in this way China's banking industry associations as industry organizations can meet the needs of China's economic and financial development industry organizations.
