Researches On The Regulation Of Competitive In Telecommunication Industry

With regulations of telecommunication industry becoming more and more consummate, the competitive regulation of telecommunication is not strange to human beings any more. What's more,it becomes an important part in the innovation of telecommunication regulation, and many countries and districts,such as Europe and U.S.takes serials of measures to improve their competitive regulation of telecommunication.In this circumstance,more works should be done on the establishment and improvement of telecommunication competitive regulation.Based on the 3-step research plan,i.e.firstly raising the questions and then analyzing them,and finally solving all the questions,this paper intends to make some proposal on how to perfect competitive regulation of telecommunication in China with the research methods of inductive analysis and enumeration,under the guidance of economic law and comparative law.Firstly,through the comparison between competitive regulation of telecommunication and industry regulation,this paper summarizes related content of former control and points out its pattern classification.Secondly,comparative analysis is adopted to the pattern of competitive regulation.According to the analysis of typical countries,we can divide the pattern into four types:Auxiliary competitive regulation model;parallel competitive regulation model;leading competitive regulation model and complete competitive regulation pattern.Furthermore,the advantages and disadvantages of the four regulation patterns also are analyzed and summarized.Thirdly,China's exact type of regulation is discussed along with the development trend of our telecommunication control and concerned rules and regulations stipulated by Antimonopoly law,and conclusion can be made that the competitive regulation in our country belongs to auxiliary competitive regulation pattern.Based on this conclusion, focus is put on the problems in the process of competitive regulation.Finally,legal advices which can further promote the competitive regulations of telecommunication are proposed from both the aspects of advanced foreign experiences and the practice of China.
