China has already become to be an aging society,and will face the aging tide soon.Anyhow,the old-age security system of our country remains relatively lagging behind.The aging of population has brought the governments,enterprises,and families heavy burden.The contradictory between the aging of population and the insufficiency of social security system is more and more prominent.Thus,to seek new ways of old security to improve the life quality for aged people,has become currently an urgent matter. As a new model of pension with houses,Reverse Mortgage releases equity in housing to improve the aged people's living standard by the way of housing guarantee without changing the rights of inhabitation.Reverse Mortgage is a kind of financial products which was designed for the elder people and operated by several different kinds of financial institutions at the same time. Reverse Mortgage system was developed in other countries and has been proved as an effective way to solve the problem of society aging.At present, this system has been paid more attention by the governments,academies and the financial sector.This thesis attempts to study how to build Reverse Mortgage system in our country from the legal view.Firstly,the writer analyzed the definitions,the comparison between Reverse Mortgage and real estate mortgage and the basic pattern.Secondly,the general principles,was introduced,barrier and countermeasures during its developing process were emphatically analyzed. Thirdly,based on our country's situation,the necessity and feasibility of setting up Reverse Mortgage system in China were discussed.Finally,legislative proposals were put forward on the basic pattern of Reverse Mortgage system in our country from the views of operation,monitoring and system designing.
