The real estate is the important pillar industry of our national economy, the development of the real estate is one of the important strong points that the national economy increases continually and steadily. Whether what the tax system of the real estate is made plays an important role to development that the real estate could be healthy rationally. In 1994 our national tax policy of real estate has formulated and continues to use until now. So, our national tax policy of real estate has some flaws. It already obviously lags the development of the real estate market. With the rapid development of real estate, the investment is heavily. Our government has made regulation recently, the Third Plenary Session of the 16th Party Central Committee held on October 2003, announces: Reform taxes and fees in cities and towns' construction, condition levy and unify the normal Property Tax on real estate when possessing, cancel having something to do charge correspondingly. The fifth Plenary Session of the 16th Central Committee of the Communist Party of China held in October, 2005, announces "the Proposal on the Eleventh Five-year Program''. It refers to clearly: "implement property tax steadily."This research starts with the correlated theory of property tax. Afterwards, it introduces our country present real estate tax system and pointed out some main problems. Such as the taxes during the holding the real estate is lower, the range of collecting taxes is too cramped, the basis of calculate the taxes is not reasonable, and the design of the tax rate is not flexible. On the basis of the analysis of the property tax levy and the conditions, concludes that property tax levy in China is an important means to improve China's real estate tax system. In China, property tax is still a new thing, so we need to learn advanced experience from developed countries and districts. After fully studying the advanced experience, this text has put forward a construction of China's property tax to the basic framework of the system.
