Study On The Legislation Of China's Policy Bank

China's policy banks is closely related to the reform of the financial system .In order to meet China's reform and opening up, especially the reform of the financial system, the State Council made"a decision on the reform of the financial system"on December 25, 1993 and decided to set up three policy banks which are the State Development Bank of China, Agricultural Development Bank and the Export-Import Bank of China, to separate policy-oriented financial from commercial financial , resolve the question on the state-owned commercial banks which hold two posts simultaneously ,cut off the direct connection of policy-based lending and base money and ensure that People's Bank regulates and controls the base money initiative. Since three policy banks set up, they have made brilliant achievements in the respect of supporting country priority building , boosting a marketplace electromechanical product outlet, protecting and stabilizing grain cotton and so on , has created advantage for the country financial reform and has brought the significant effect on the economic structural reform.More than 10 years, policy banks operating environment has changed, China's market economy has made significant progress, the basic framework of socialist market economy has initially taken shape and the demand for subsidies is more and more less; on the other hand, because our country's financial continue to improve, some things policy banks do can be completed completely by the state finance. These changes make policy banks face a new challenge. At present three policy banks operate in accordance with the State Council's the"decision on the reform of the financial system"in 1993 and regulations that every bank works out. Not only the legal effect is limited, but also they are not adjusted to at present management environment very much .The absence of law caused many problems, such as vague policy banks'position, the lack of sustainable development capability, the lack of capital, the unhealthy corporate governance structure and internal control mechanism, and so on. Therefore, there is an urgent need for policy banks of the legislation .on the one hand, it can provide a theoretical basis for national decision-making authority and make our country's legislation meet the reality of China's policy banks ; on the other hand it can improve legislation of China's financial system.The author uses the value analysis method, parallel method and logic analysis method, takes science of law, economics, study of finance as basic theory. Analysis by the meaning and characteristic to policy banks and study on concept policy banks, nature, basic principles and jurisdictions attribution, the author try to build rationale of"policy banks law"legislation. Taking the basis on legislation comparison home and abroad, the author makes a systematic conception on legislation to our country"policy banks law".
