The theory of effective competition is to deal with the dilemma between scale and competition. In telecom industry, it is a core issue that governments face, including Chinese supervisor. Nonequilibrium exists in current Chinese telecom market and CMCC owns a significant market power. Research on how to relieve the dangerous tension in 3G era is meaningful and urgent for Chinese government.The thesis proposed that asymmetric regulation should be taken to standardize telecom industry to achieve effective competition. This kind of regulation ensures thatthe effective competition converges on a dynamic equilibrium area——MarshallBuffer Area. Then, based on SCP theory, the thesis statistically analyzed Chinese telecom market after carrying out the asymmetric regulation in the aspects of market structure, market behavior and market performance. The thesis also summarized the new circumstances in 3G era which need asymmetric regulation be updated.At the last part, the thesis reviewed the foreign experience in this field especially how to classify SMP operators and what policies should be released. Furthermore, it put forward some related policy suggestions in 3G era. The concrete content includes the following aspects: the first step is establishing a SMP evaluation system in china; the second step is designing a feasible regulation framework, and it should be a package of essential proposals.
