Local Government Intellectual Property Construction

With the coming of knowledge economy, the status and functions of it has been historically promoted and its importance is becoming more obvious and it has therefore become an important means of development and competition for many countries. The creation, management, protection and applying of intellectual property rights will be an inevitable choice in enhancing the core competitive power , strengthening the national power and promoting the society to sustained, coordinated and fast development. After China's entry to WTO, how to adapt the development of economy and provide a safeguard with related institution, organization and policy has become an important task in the management of intellectual property rights for the local governments in China nowadays. Since the introduction to the open and reform policy, China has gradually built a relatively complete management system of intellectual property rights and has achieved great progress in the management of intellectual property rights. However, as started building the system relatively later than other countries, its rate of developing is relatively low and presents many problems in its system and management. What's worse is that the absence in the management system of local government's intellectual property rights makes the economical functions of the society not perfect enough. As a result, it won't be able to adapt the intensely competitive international environment in the time of knowledge economy in an easy way.The author has been engaged in the research of the management of local intellectual property rights for a long time. And in the paper he takes the regional intellectual property rights management system as the main role. Using the theory and methods in managing the intellectual property rights , the practices of building the management system of the local intelligent property rights in Xiamen, and based on the analysis of the intellectual property rights management at the time of knowledge economy , the author analyzes the present situation and problems in the management system of the local intellectual property rights, and according to these, he puts forward some main targets and situation measures and solutions to make the management system of the local intellectual property rights better.The paper consists of the following four parts: The first part deals with the function and the necessity of the intellectual property rights management at the time of knowledge economy. It analyzes the basic content and characteristics of the time of knowledge economy, the function and localization of the management of the intellectual property rights in the time of knowledge economy, and lays the foundation for the formulation and implementation of local management system of intellectual property rights.The second part talks about the present condition and problems of the local management system of intellectual property rights .Based on the thorough analysis of the present situation of local intellectual property rights, the author claims that the problems of unbalanced construction in the management construction of local intellectual property rights, dispersed management, lack of communication & coordination mechanism etc. exist in the present management system of local intellectual property rights.The third part concerns the thoughts about how to improve the local intellectual property rights management system. It mainly puts forward some main targets and situation measures and solutions to make the the management system of the local intellectual property rights better.The fourth part takes Xiamen as an example to analyze its practice in building a coordinated mechanism of local intellectual property. The author also makes a quest into it and put forth several thoughts.The originality of the paper is that it completely and systematically makes a standard research into the local government's intellectual property right from the aspect of modern public management. This is rarely found at home and abroad. Investigating the construction of local government's intellectual property management system can make up for the insufficiency of the research in this field, helps improve the intellectual property system, and offers a reference of practices and theory in promoting the building and improving the modern intellectual property system. However, as the intellectual property management system in China is still at the initial stage, it meets many problems and challenges. Due to the limitation to the length of the paper and the author's academic research ability, there is some unavoidable impropriety and incompleteness that requires further study in the paper.
