| Textile is a traditional industry for export in China. Now China is the largest producer and exporter in the world. United States is a main export destination of Chinese textiles, but United States requests Chinese Textiles to meet the requirement of flammability standards under Flammable Fabrics Act, so that we have been blocked. In my country, there is no special law of flammability fabrics and the applicable mandatory standard is on a relative small volume and at a lower level. So we imminently need to make a comprehensive interpretation to it so as to promote the legislative research on the flammable fabrics in China.Based on protecting domestic textile industry and consumer product safety, the United States enacted the Flammable Fabrics Act in 1953, and then formulated a variety of fabrics flammability standards. Flammable Fabrics Act mainly includes terms, forbidding trade, flammability standards or regulations, administration and enforcement, guarantee, Exemption, preemption of federal standards, Congressional veto of flammability regulations etc. It sets up specialized agencies Consumer Product Safety Commission which develops related flammability and is responsible for the implementation of this law. Looking at China's legislative status of flammable fabrics, because of the lack of a special law, and the crossing of functional department, the improperness of the mandatory coverage, the poor maneuverability of enforcement standards, therefore, we should combine China's specific conditions and draw the advanced legislative experiences of the United States and other countries, to establish China's flammable fabrics act, grasping legislative purpose, principles and designing the specific content. At the same time, the government and enterprises should also take corresponding measures to deal with.I hope that this paper can bestead the construction of legislative system of flammable fabrics and the prosperous development of the textiles import and export in our country. |
