Intellectual Property Management In The National Key Technology R&D Program

The Projects of Substitution Technologies of Nontoxic and Innoxious Materials belong to the National Key Technology R&D Program for the 11th five-year plan. The direct inducement of the Projects is the issue of EU's WEEE & RoHS directives. Electronics industry is affected and turned to technology innovation for help. From the beginning of the "Substitution Technologies Projects", it is contributing to joint the industries, universities and research Institutes in order to centralize the existing domestic resources for R&D. The projects focus on the technologies' industrialization and commercialization ability in a large industry scale which leads to the improvement in the exporting goods' competition ability to break through the TBTs in the international market. In the "Substitution Technologies" project, Intellectual Property Management is essential for achieving the objective of the project based on the following reasons: firstly, it is the foundation of the projects' approval. Secondly, the efficiency of the management can affect the process of the projects and influence the benefit both socially and economically.This thesis is based on the officially released policies and regulations in the National Science and Technology Plan. Using the systems theory, it discusses the important requirements regarding to 3 main aspects of Intellectual Property Management (the IP creation, IP protection and IP diffusion) and figures out some management measures correspondingly. They are the synergetic design for the IP creation, the three-dimensional modular design for IP protection and the coordination design with standardization process for IP diffusion. To assure the management's operability, the author sets up a guideline for some of the rules in the projects. She also draws a clear organization structure chart for the IP management Department in the "Substitution Technologies Projects".This paper can provide some reference values to the projects' managers of the national science and technology as well as the related personnel in its intellectual property management field.
