The purpose of the intellectual property is to protect the private knowledge and to stimulate the technology innovation by giving the oblige certain monopoly rights of the knowledge for the compensation of the development cost. Under the condition of knowledge economy, information and knowledge become the most valuable assets that make the core competence and decide the outcome of the international competition. So the intellectual property rights receives the greatest attention. The developed countries freely make use of the IP to protect their advanced technology and information to keep their competing advantages by laying trade barriers of IP to the developing countries which cause great lost. During the international competition, the developed countries lock in their core technology through FDI to developing countries,the purpose is not to help the developing countries with their technology advancement, but to get more profits. Under such conditions , The trend " technology patentization , patents standardization , and then standards authorization" becomes more and more popular which enlarge the monopoly of the IP and impede the process of the trade liberation. As one of the most greatest developing countries with huge amount of international trade, our enterprises encounter the trade barriers of IP which threaten the economy safety of the firm, industry even the whole country. What to do to cope with this trend? This paper concludes that in order to steer clear of the IP trade barriers, the firm have to , on one hand , take effective measures to develop technology by cultivating industry clusters around the transnational company to form intimate industry linkage with them; on the other hand , our enterprises must change the innovation strategy based only on the marketing investigation. Analyzing the huge mount of the patent documentary will help us not only understand the innovation strategy of the rivals, but cut the technology development costs, because the documentary includes almost all the technology information of certain industries and products. These two measures supplement each other and will become the right way to steer clear of the IP trade barriers.
