| Since China joined the WTO, its increasing speed of clothing exporting has grown very quickly. But at the same time, there still have some problems in the whole industry, one of which is infringing the intellectual property rights of the world famous clothing corporation. At present, this infringing intellectual property rights behavior is very seriously in our clothing industry. For example, there existed a lot of behaviors like counterfeiting trademark and copying design. Even though, those behaviors can bring profit to the enterprise in short term, at the same time they provoked many international trade dissensions, and will hinder the development of our clothing industry in long term.At present, there are lots of articles that expatiated the problem of infringing the intellectual property rights. But most of them expatiated it form high-technology field. So basing on clothing industry, the writer tries to combine the related international or domestic laws to analyze the behaviors practically. Unlike the majority of the articles, the writer devised article by the kind of infringing the intellectual property rights behaviors, so this is the innovation of this dissertation. In the dissertation, the behaviors are divided into two kinds, and every kind can be divided more particularly. By this way, the writer wants to bring readers with more intuitional and definite reorganization. At the mean while, it could help clothing enterprises to check their behaviors, in order to avoid infringing the intellectual property rights.The dissertation can be divided into five parts:The first part is foreword, which includes the meaning of research of this dissertation; research method and the innovations in the article; literature summarize.The second part introduces the definition, sort and characteristic of intellectual property rights. Then explain the embodiment of it in international trade.The third part introduces some related laws mainly include international and domestic laws. For instance, in this part, it introduces Word Intellectual Property Organization (WIPO) and its treaty, and then is WTO and Agreement On Trade-Related Aspects of Intellectual Property Rights (TRIPS).The forth part is the principal content of this dissuasion. In this part, the writer narrate the development of China clothing industry, then explain the situation that lacking own intellectual property rights, and the harm it brought to this industry's export. In succession, it is analysis of the infringing rights behaviors, which is the innovation of this dissuasion. The behaviors are divided to two parts, including infringing trademark and fancies design rights.The last part is countermeasure introduction. In this part, the countermeasures are brought forward in three lays, which are macro-scopical (government) lay, median-scopical (industry association) lay and micro-scopical (enterprise) lay. |
