Research On Public Corps' MBO In China And Related System Circumstances

In short several years, China's MBO has experienced four phases: emergence, prevalence, prevention in urgency, travel in zigzag. What is status of MBO? Whether MBO itself has defectiveness or China's system circumstances have faultiness? Presently, which system circumstances have been restraining MBO carring into execution effectively? How can perfect our system circumstances in order to successful execution of MBO? This paper highlights in depth these issues.Firstly, this paper introduces system value of MBO from the angle such as agency cost. Then, it analyzes the background of MBO' Emergence. Based on analyse of nucleus process of MBO, it supplies a systematic research on system circumstance of MBO in home and abroad. It has a conclusion that there are notable differences in system circumstances of emergence and implement between China's and foreign countries' MBO. It is a "indigenous" MBO in Chinese enterprises, which, consequently, leads to a notable effect in China. And then, samples 22 public enterprises from 2001 to 2004, analyzing the status quo and system circumstance impact on MBO. It concludes that there are multiple legal obstacles in China and they limit the implement of MBO in present. The performance of Corps which have executed MBO has little improvement. Therefore, it is very necessary to perfect system circumstances of MBO in China. Finally, some feasible measures on MBO such as special legal system are put forward to perfect system circumstances.
