Research On Circumvention Against Anti-dumping & Issue Of Anti-circumvention And The Counter Measure Of China

After joining WTO in 2001, China is facing more and more serious trade remedy problems. With the further development of economic globalization and frequent application of anti-dumping, anti-dumping has further developed to anti-circumvention and attracted more and more concerns from international community. Anti-circumvention is a kind of measures taking against the behavior circumventing anti-dumping. When one commodity is levied anti-dumping duty, its manufacturer or exporter continue to dump the same commodity by varied means such as changing the country of origin or exporting modes. Such behavior is circumventing anti-dumping. However, anti-circumvention is the remedies that the importing country takes against the circumvention behavior by foreign exporter.Up to mid September 2005, all the anti-circumvention investigations against China reached to 14, among which, EU 11, US 2, Argentina 1. The success ratio of initiating anti-circumvention investigation cases and imposing anti-dumping duty is high, and also higher than the success ratio of initiating anti-dumping investigation cases and imposing anti-dumping duty. Among fourteen cases, nine cases had been concluded and eight cases had been imposed anti-dumping duty. The success ratio of initiating investigation and imposing anti-dumping duty is 88.9%.With increasing of anti-dumping cases against China, China will suffer more and more anti-circumvention cases. Till now, China has become the most serious victim in the world.As anti-dumping wide spreading, circumventing anti-dumping is developing rapidly and increasing in categories and becoming more and more effective. Anti-circumvention has drawn more and more attention.
