An Analysis On The Resistance An Countermeasures Of China’s Current Enironmental Protection Law Enforcement

China’s economic development has made remarkable achievements. However, therapid development of the economy is at the expense of the environment. China’senvironmental problems have become increasingly prominent which has seriously affectedpeople’s daily lives and health. Though the government has successively promulgated aseries of environmental laws and regulations to protect the environment, environmentalissues are still very serious, environmental pollution incidents still occur sometimes, andthere is no trend to stop. One of the most important reasons for this phenomenon is thelocal environmental protection law enforcement inefficiency. The failure of abiding by andenforcing the law making environmental laws and regulations can’t be effectivelyimplemented. Therefore, deeply exploring the existing resistance in environmental lawenforcement and proposing the countermeasures to overcome the resistance is important toimprove the effectiveness of our environmental law enforcement and the environmentalconditions.Firstly, this paper briefly represents the current situation of China’s economicdevelopment and environmental pollution, introduces the environmental law enforcementelements, characteristics, and meanings, at the same time, and analysis the currentsituation of China’s environmental legislation and law enforcement through examples anddata. Secondly, it discusses the present resistance of the environmental law enforcementfrom four aspects: interests, systems, structures and concepts. Finally, in order to resolvethe presence of resistance to environmental law enforcement, it puts forward somesuggestions. Which are: first, to perfect the enforcement of environmental laws andregulations; Second, to strengthen the construction of environmental law enforcement interms of taxation system, officials appraisal system, accountability system, etc.; Third, topromote the construction of institutional mechanisms for the environmental protection lawenforcement, so that all law enforcement bodies can join together to play a linkage role.Last, to improve the activity of the law enforcement body’s and the legal awareness of thebusiness and people’s through education, advocacy, encouragement and other ways which should create a favorable environmental law enforcement environment and efficiency.
