Legal Issues Study On The Use Of Clean Coal Technology

China is the world’s largest coal-producing and consuming country. Coal is China’s main energy. However, there are many problems and challenges in the development and utilization process of China’s coal resources, such as ecological damage caused by traditional mining methods, air pollution problems of inefficient coal-fired and low resource utilization. These issues is a challenge to national energy security and sustainable economic developments, it is a major problem in the field of energy to our country. The government must increase the intensity of clean coal technology to optimize the coal-dominated energy structure and various resources and environmental problems. Implementation of laws, regulations and national policies to promote clean coal technology applications in our country is the key to solving these problems.This article includes four parts, first we explore a large number of literature to sum up China’s clean coal technology legal system provisions and various stages of clean coal utilization technology policy. Summed up in China since1986the State Council issued the " Provisional Regulations on the Control of Energy Conservation ", include " Coal Industry Law of the People’s Republic of China "," Energy Conservation Law of the People’s Republic of China "," Cleaner Production Promotion Law of the People’s Republic of China " and so on all involve promoting clean coal technology research and development to promote the institutional system until today. The existing legal regime on our clean coal technologies summed up in two stages, and analyzes the characteristics of the various stages of development, enriching the previous studies, summarized the legal system of China’s clean coal technology applicable to the problems, includes two aspects, One is the lack of clean coal technology research and legal protection of the legal system is not yet complete result, the cost of clean coal technology industry lacks legal support; The second is the legal consciousness of citizens of cleaner production, the development of the concept of a slight deviation.By the research of China’s clean coal technology in the legal regime applicable to the problem, the second part of this paper, the necessity and feasibility of clean coal technology legal construction carried out a detailed analysis. Necessity analysis includes mine ecological destruction, air pollution, low resource utilization three aspects. Feasibility analysis about in two ways, our country already has a legislative basis and developed countries have a successful legislative precedent. The third part of this article, we summarized the law and applicable of clean coal technology in developed countries, and overall assessment of it.Reference advanced legal, policy experience in developed countries, the fourth part of this article reach the following conclusions:To break through the bottleneck stage of development and application of clean coal technology, and the urgent need for the country to play a legal functions, not only need to improve and amend relevant laws and regulations at the national level, the need to develop national laws, policies supporting local regulations in place, to form a complete set of top-down legal system. Use various policy tools, actively promote the development and widely used of clean coal technology. Legal advice to promote the practical application of clean coal technologies presented in this paper includes five points:1, amendments to improve the legal system, promote clean coal technology to make a clear, workable legal provisions and liability provisions.2, establish financial support system, promoting clean coal technology fiscal legislation, including tax incentives and subsidies.3, strengthen the government’s legal obligations, through legislative and administrative policy, a reasonable construction of the relationship between law and policy, effectively promote the development of clean coal technologies.4, enhance the legal awareness of citizens of cleaner production, making the development of clean coal technology has good external social environment.
