Study On International Trade Sales Contract Frauds

Starting from analyzing the basic concept of the fraud of international trade salescontracts, this paper makes legal analysis and economic analysis in depth. In the partof legal analysis, The paper points out the fraud of international trade sales contractsis an invalid kind of legal act, also tortuous act. So its legal liability should be dividedinto three parts, civil liability, administrative liability and criminal liability.Meanwhile, the paper further studies corresponding remedies, including the remediesby their own, the civil remedies, the arbitration remedies, the administrative remediesand the criminal remedies. In the part of economic analysis, the paper first analysisthe main causes of the fraud of international trade sales contracts, then studies theall-around countermeasures for it in different phases. Finally, the paper studies thetrend of the fraud of international trade sales contracts----the fraud of electroniccontract. In the future, electronic contracts would be the main carrier of salescontracts. To prevent the fraud of electronic contract in international trade, we shouldimprove on the technology, the laws and regulations etc. so as to prevent the fraud ofelectronic contract in the maximum limit.
