Research On Several Problems Concerning Zhejiang Province Land Administration System Reformation

In December 2003, the center government decided to put into effect of the plan of vertical management of land at all levels under the province government departments in order to intensify Macro-control on land resource and to implement the most stringent farmland preservation system; in October 2004, the State Department issued State Council's Decision of Deepening Reform and Being Strict with the Management of Land (State issue [2004] No.28); in October 28 2004, the State Council convened a TV & phone meeting about the work of deepening reform and being strict with the management of land, and Prime Minister Wen Jiabao gave important address on this meeting. Apparently now land management and its relevant issue concerning reform of management system administration are attracting wide attention among every walk of life in China.Today land problem places a very important part in human existence and development, and is becoming a hot issue over the world. Also in China, as the perfection of Socialist Market Economy goes on and the impetus of citilization process, all levels of government departments and people begin to pay closer attention to this issue. In this social transition period, land is not only taken as a key measure by the basic government to improve the city image and attract investment, but also an important resource to proceed industrialization. Under the circumstance ofoverheated investment in fixed assets, in early 2004 the State Council stress to control the land utilization in order to establish a resource-conserving and circular economy. Meanwhile, as more farmland are confiscated, and people's awareness of property right and law enhance, more people realize to protect their land asset, therefore, the content of letter-visit concerning land problem also increase, e.g. compensation of the confiscated land; land ascription dispute; regulation-violated construction; embarrassment of the county-level Land Department (both local government leaders and the mass are unsatisfied), etc.: the above problems have their inevitability, either historical or practical, together with some shortcoming of the land management itself, all need our further research and discussion.This thesis is based on the recent vertical management revolution of land management system, mainly studying the merits and demerits of the new mode after Zhejiang province implementing this land vertical management, and discussing the transition of relevant administration function. Combining her personal experience of working at the basic level of land management, the author puts forward some new solutions concerning the problems she has ever met, and wish it could be of some practical significance to the implement of No.28 Document of the State of Council and the fulfillment of the most stringent farmland preservation system.
