As known as the South China Sea, South China Sea is the largest ocean in the Asia-pacific region, and also communication two oceans and three continents important hub at sea. Rich resources make it won its reputation as the "second Persian gulf". Nowadays the development of oil and gas resources has been important, the rich oil resources not only become the measure of power standard, but also be promote a country’s economic growth, an important indicator of the improvement of comprehensive national strength. Chinese as one of the earliest development and utilization of marine resources of the country, attach great importance to the issue of the South China Sea. The full text in describing the countries to compete for status after the South China Sea joint development of the South China Sea, pointed out the existing legal problems, thoughts and finally puts forward the dispute settlement mechanism, the full text is divided into five parts.The first chapter mainly introduces the domestic and international current situation and research background of the South China Sea. The second chapter introduces the current situation of the oil and gas resources in South China Sea prospects the future development trend of Chinese. The third chapter focused on analysis of the current international law problems of the joint development of the South China Sea:First is the Islands Sovereignty Dispute and various policies. Secondly, maritime demarcation disputes, and discusses the storm caused countries to submit outer continental shelf. Thirdly is the common problem in the exploitation of the region. The fourth chapter mainly put forward the South China Sea countries to jointly develop practical significance for China to solve the South China Sea oil and gas resources. The fifth chapter is the focus and innovation of this paper. It mainly puts forward some thoughts on the South China Sea oil and gas resources joint development of dispute settlement mechanism, Are based on specific rules of international law to solve the island dispute, the application of fair principle to solve the problem of demarcation disputes in the South China sea, Claims that China has the south China sea line nine historic rights and focus on the common development of designation and the solution of the third party rights.
