| A large area of overlapped EEZ claims of China and Korea caused the issue ofmaritime delimitation. China and Korea has been engaged in seesaw negotiations onthe issue, but because of different basic principles, there is no relatively optimizedsolution for this for a long time,even a periodical consensus has not been reached.Currently, the main reference on the issue of EEZ, especially the issue of fisheriesbetween the two countries is China-Korea Fisheries Agreement signed in2000.However, the delimitation system of the agreement,whose negative influence hasbeen quite obvious, is unjust in respect of its scheme and its consequence, therefore, itis necessary for us to create a more resonable delimitation system instead. In thenewly lauched China-Korea maritime delimitation negotiation, our country will havethe opportunity to change the unfavorable situation caused by China-Korea FisheriesAgreement.This paper argues that, within the framework of rules and practice of moderninternational law, concerning operational feasibility and national interests of ourcountry, maritime delimitation between China and Korea should be solved mainlyfrom following aspects: regarding the reversing of the adverse impact caused byChina-Korea Fisheries Agreement as the starting point; solving delimitaion disputethrough the method of agreement; distingushing the delimitation of the EEZ and thedelimitation of the continental shelf; determining reasonable “relevant circumstancesâ€;promoting delimitation and fishery cooperation at the same time. |
